Cet article vise à justifier, puis à appliquer une éthique climatique centrée sur les intérêts des acteurs économiques. Après avoir expliqué pourquoi le changement climatique pose un problème important de motivation, je montre pour quelles raisons les incitations peuvent au moins partiellement y remédier. Je développe ensuite deux possibilités d’institutionnalisation de l’éthique des incitations. La première consiste en une taxe internationale augmentant progressivement le coût des émissions de dioxyde de carbone, un dispositif auquel il convient d’ajouter des subsides pour la (...) recherche, le développement et le déploiement des énergies renouvelables. La seconde consiste en un marché global du carbone qui vise également à décourager l’utilisation des combustibles fossiles et à encourager l’utilisation de sources alternatives d’énergie. L’objectif est de montrer qu’une éthique climatique prenant en compte le problème de la motivation est plus efficace qu’une position qui se limite aux devoirs moraux incombant aux consommateurs et producteurs, soit de réduire leurs émissions. Le respect de la vie privée et de l’intimité est un droit reconnu aux usagers des services de santé et des services sociaux par différents codes d’éthique, par la Charte des droits et libertés de la personne du Québec et par la Loi sur les services de santé et les services sociaux. Pour autant, la signification que prend ce droit demeure incertaine. Il n’y a pas une signification, mais bien des significations. S’appuyant sur un important travail d’observation dans deux comités (...) d’éthique clinique situés dans des établissements de santé et de services sociaux, les auteurs présentent et analysent ici un certain nombre de situations litigieuses dans lesquelles une interprétation du droit à la vie privée et à l’intimité a été faite. Au terme de l’exercice, il ressort entre autres que, selon les situations analysées, les discussions qui se font dans les CÉC conduisent à des modalités différentes (« déplacement et hiérarchisation », « opposition et évitement », « ouverture et compromis », « élargissement et remise en question ») qui ont pour effet de changer le regard porté sur l’usager et plus spécifiquement de faire comprendre son point de vue. En outre, si le droit à la vie privée et à l’intimité contribue à modifier l’interprétation que l’on se fait d’une situation ou des usagers, il est lui-même objet d’interprétation. C’est la diversité de sens qu’il peut prendre qui lui préserve son pouvoir d’interroger. (shrink)

Questo contributo riguarda il tema specifico dell’umiltà come virtù etica e nasce all’interno di uno studio più ampio sulla relazione tra umiltà in campo morale e umiltà intellettuale, tema ricorrente tra i sostenitori della Virtue Epistemology. L’intento di questo saggio è quello di approfondire il recente dibattito circa la natura dell’umiltà come virtù e la sua definizione e il mio obiettivo è quello di mostrare come la tradizione aristotelico-tomista, generalmente sottovalutata da chi si occupa di umiltà nella filosofia analitica contemporanea, (...) possa fornire una risposta soddisfacente alle problematiche più recenti relative a questo tema. La struttura di questo breve contributo prevede un primo paragrafo in cui offrirò una sintetica panoramica sulla concezione di umiltà di Aristotele e Tommaso d’Aquino. Quindi, nel secondo paragrafo, analizzerò la ricezione di questa virtù all’interno della filosofia morale contemporanea di matrice analitica, affrontando due problemi di cui qualsiasi definizione di umiltà deve dare spiegazione: la compatibilità di umiltà e conoscenza di sé, e la possibilità, per chi eccelle in un determinato ambito, di essere umile. Mostrerò come la tradizione aristotelico-tomista possa fornire una risposta efficace a tali quesiti recenti e presenterò i tratti generali della concezione di umiltà come virtù relazionale. L’obiettivo di questa bibliografia tematica, tuttavia, è quello di fornire al lettore una panoramica, sintetica ma informativa, sull’evoluzione dell’epistemologia delle virtù nell’arco di quasi quattro decenni. La selezione dei testi che verranno menzionati in questa bibliografia tematica tenta, per quanto possibile, di rispettare lo sviluppo cronologico dell’epistemologia delle virtù. Tuttavia, il criterio che ho scelto di adottare per la classificazione di queste opere è primariamente tematico: dopo una prima sezione dedicata alle origini dell’epistemologia delle virtù, verranno indicati alcuni testi che (...) rappresentano gli sviluppi teorici fondamentali—o, a mio avviso, meglio riusciti—di questa corrente, alla luce delle critiche che le sono state via via rivolte con il passare del tempo. Infine, nella terza e ultima sezione saranno proposti alcuni lavori che indicano i nuovi orizzonti della ricerca nell’epistemologia delle virtù e le sue possibili implicazioni in altri ambiti filosofici. Come si può facilmente immaginare, la selezione dei testi è frutto di una scelta, motivata ma comunque opinabile, ed è dettata da limiti di spazio. Pertanto, questa bibliografia tematica non può avere né l’ambizione di mettere tutti d’accordo, né la pretesa di essere completa. Il miglior auspicio è, piuttosto, che queste brevi considerazioni possano suscitare l’interesse del lettore e invitarlo ad approfondire lo studio dell’epistemologia delle virtù nelle maniere che questi riterrà più opportuno. Cet article vise à enrichir l’approche désagrégative proposée par Cécile Laborde dans Liberalism’s Religion [HUP, 2017] à l’aide de certaines intuitions rawlsiennes provenant de notre ouvrage La nation pluraliste [PUM, 2018]. En partant de la notion d’« accommodement raisonnable » telle que comprise dans le contexte légal du Québec et du Canada, nous parvenons à une interprétation des fondements normatifs de la distinction entre droits fondamentaux et accommodements qui repose sur la raison publique. Vous pouvez obtenir un résumé rapide de ce livre sur p 135 ou 326. Si vous n’êtes pas, à la hauteur sur la psychologie de l’évolution , vous devriez d’abord lire l’un des nombreux textes récents avec ce terme dans le titre. L’un des meilleurs est "The Handbook of Evolutionary Psychology" 2nd ed par Buss. Jusqu’à il y a une quinzaine d’années, les «explications» du comportement n’ont pas vraiment été des explications des processus mentaux du tout, mais plutôt des descriptions (...) vagues et largement inutiles de ce que les gens ont fait et ce qu’ils ont dit, sans aucune idée de pourquoi. Nous pourrions dire que les gens se rassemblent pour commémorer un événement, louer Dieu, recevoir ses (ou ses) bénédictions, etc., mais rien de tout cela décrit les processus mentaux pertinents, donc nous pourrions dire qu’ils sont des explications à peu près de la même manière qu’il explique pourquoi une pomme tombe au sol si nous disons son parce que nous l’avons libéré, et il est lourd-il n’y a pas de mécanisme et pas de puissance explicative ou prédictive. Ce livre poursuit l’élucidation de la base génétique du comportement humain qui a été presque universellement ignorée et niée par le milieu universitaire, la religion, la politique et le public (voir l’excellent livre de Pinker ''The Blank Slatè'). Sa déclaration (p3) qu’il est inutile de demander si la religion est génétique est confondue comme le pourcentage de variation de tout comportement dû aux gènes et à l’environnement peut être étudié, tout comme ils le sont pour tous les autres comportements (voir par exemple, Pinker). Le titre devrait être "Tentatives préliminaires pour expliquer certains aspects de la religion primitive" car il ne traite pas du tout la conscience supérieure (par exemple, satori, illumination, etc.) qui sont de loin les phénomènes les plus intéressants et la seule partie de la religion d’intérêt personnel pour les personnes intelligentes et instruites au 21e siècle. En lisant tout ce livre, vous ne devineriez jamais que de telles choses existent. De même, pour l’immense domaine de la drogue et de la religion. Il manque un cadre de rationalité et ne mentionne pas les deux systèmes de vision de la pensée qui sont aujourd’hui si productifs. Pour cela, je suggère mes propres articles récents.. Néanmoins, le livre a beaucoup d’intérêt, et en dépit d’être daté vaut encore la peine d’être lu. Ceux qui souhaitent un cadre complet à jour pour le comportement humain de la vue moderne de deux systemes peuvent consulter mon livre 'The Logical Structure of Philosophy, Psychology, Mind and Language in Ludwig Wittgenstein and John Searle' 2nd ed (2019). Ouvrant la réflexion sur les enjeux de la perte massive de la biodiversité, l'article s'appuie sur la question élémentaire de l'importance de la diversité biologique pour l'homme, à la fois sur le plan économique, biologique et éthique. La maîtrise de la nature par l'homme se révèle être une illusion. La réalité étant celle de l'interaction, il est permis de dire que les sociétés humaines agis- sent sur leurs propres conditions en modifiant les équilibres biologiques pour satisfaire leurs besoins, sans pour (...) autant intégrer cette interaction fondamentale dans l'équation d'un rapport viable entre l'homme et la nature. L'approche récente par le biais des analyses des services éco- logiques constitue à cet égard un progrès sensible. Il aboutit néanmoins au constat de l'impos- sibilité pour l'humanité de se substituer aux mécanismes naturels permettant de tirer les ser- vices de la nature nécessaires à sa survie. Plutôt que de prétendre contrôler et maîtriser la nature à tout prix, l’homme devrait apprendre à se reconnaître comme une partie consciente de la nature et à vivre avec la vie qui l’entoure. Cet apprentissage soulève des défis scientifiques, humains et de gouvernance. L'article prône la nécessité d'une science de la biodiversité intégrée et non plus éclatée, condition essentielle pour l'élaboration de politiques économiques et sociales qui intè- grent la viabilité de l'utilisation des ressources naturelles et des services qu'elles procurent. La conception de la promotion de la santé consacrée dans la Charte d'Ottawa accorde à l'autonomie une place centrale. Or, il n'est pas clair que la santé définie au sens large et l'autonomie soient liées au sens où semblent l'entendre les auteurs de la Charte. De plus, la promotion de l'autonomie auprès de groupes qui ne la considèrent pas comme une valeur centrale reste à justifier. Le présent texte présente une conception de l'autonomie et de sa promotion qui permet de (...) répondre à ce dernier problème. Des exemples de politiques publiques en contexte pluriethnique sont donnés afin d'illustrer comment la conception de la promotion de l'autonomie proposée se démarque de politiques plus coercitives. This thesis contends that the possession of a sense of humour would contribute considerably to the quality of human life. It is an exploration and discussion of some of the difficulties involved in justifying the development of humour in terms of a philosophy of education. In light of developments in the digital age with consequent changes in science, technology and society, the educated person of the future will have to be less concerned with the accumulated knowledge of the past than (...) with the development and interplay of social and natural environments. Such a person will need to have, more than ever, a sense of what is truly real and what is truly valuable in human life. If the primary purpose of education is the preparation of students for their future lives, educators are now faced with some challenging problems. Apart from the high social value of laughter, there is a recognized relationship between humour and intelligence. Knowing that the two are related proves to be a key factor in understanding the learning process and assuring that the development of a sense of humour in education is worthy of consideration. En sciences sociales, les scientifiques utilisent les rapports des sujets sur leurs propres états mentaux dans leurs démarches expérimentales. Ainsi, l’introspection, ou la capacité des sujets à former des croyances sur leurs propres états mentaux, y joue un rôle important. Selon les tenants de l’introspectionnisme, l’introspection est une méthode, certes privée, mais qui permet de justifier directement des hypothèses scientifiques. Ainsi, contrairement aux méthodes utilisées dans les sciences de la nature qui se fondent uniquement sur des données publiques, les sciences (...) sociales utiliseraient des données subjectives pour justifier leurs hypothèses. Contre l’introspectionnisme, nous défendons que l’introspection n’est pas utilisée pour justifier directement les hypothèses, mais que sa place est plutôt similaire à celle d’un instrument de mesure des états et processus mentaux des sujets, susceptible d’être calibré, à la façon dont les instruments de mesure utilisés dans les sciences... Le pari de cet ouvrage est d'explorer les facettes multiples à travers lesquelles se donne le soi. Parler de soi plutôt que de moi implique une rupture franche avec les philosophies qui placent le sujet humain en position fondatrice. Le soi est encore moins une « chose » mais un mode d'être ; le soi n'est pas une donnée mais une conquête dont le devenir est en partie indéterminé. C'est donc sous le signe des épreuves qu'il faut penser les variations (...) phénoménologiques et herméneutiques sur le soi. Si la philosophie reste la discipline dominante des réflexions qui parcourent les contributions du volume, l'originalité de cet ouvrage est d'offrir en même temps au lecteur d'autres variations par lesquelles se décline le soi. Medicine is often thought of as a science of the body, but it is also a science of data. In some contexts, it can even be asserted that data drive health. This article focuses on a key piece of data technology central to contemporary practices of medicine: the medical record. By situating the medical record in the perspective of its history, we inquire into how the kinds of data that are kept at sites of clinical encounter often depend on informational (...) requirements that originate well outside of the clinic, in particular in health insurance records systems. Although this dependency of today's electronic medical records on billing requirements is widely lamented by clinical providers, its history remains little studied. Following the archaeology of medicine developed by Michel Foucault in The Birth of the Clinic and expanding his methodology in light of more recent contributions to the field of media archaeology, this article excavates some of the underexplored technological conditions that help constitute today's electronic medical record. If in some contexts, it is true that data drive health, then an archaeology of medical records helps reveal how health insurance records often impact clinical care and, by extension, health and disease. El presente trabajo confronta el abordaje de la cuestión del sujeto en Louis Althusser y Ludwig Wittgenstein. La comparación se produce porque el tratamiento del lenguaje de la filosofía del segundo Wittgenstein es particularmente apropiado para abordar la intervención del discurso en el proceso por el cual la ideología interpela a los individuos como sujetos, según Althusser. El descentramiento del sujeto obliga a repensar la dimensión de la agencia, y con ella, la de la política. Tanto Wittgenstein como Althusser desembocan (...) en una encrucijada: negación teórica de la noción de sujeto y reconocimiento de la existencia paradójica de la misma en la práctica. Ello implica deconstruir el par "determinismo-libertad" sobre el que se asienta la pregunta por la agencia. Sobre el final retomamos el trabajo de Michel Pêcheux sobre los efectos retroactivos del discurso, lo que implica un replanteo del vocabulario de la determinación, prominente en los escritos althusserianos. -:-:-:-:--:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-:-ABSTRACT:- The present paper compares Ludwig Wittgenstein’s and Louis Althusser’s approach to the problem of subject. This comparison is motivated by the fact that second Wittgenstein’s approach to language is particularly appropriate to think of the intervention of discourse in the process of ideological interpellation which, according to Althusser,constitutes individuals as subjects. The decentering of the involved subject requires rethinking the dimension of agency and, consequently, of politics. Both, Wittgenstein and Althusser, end in a crossroads: they refuse theoretical prominence to the notion of the subject, but at the same time they recognise the practical priority of this notion, which gives it a sort of paradoxical existence. This implies deconstructing the pair “determinism–liberty” where the priority of agency is located. We end with the work of Michel Pêcheux on the retroactive effects of discourse, that entail (in agreement with Wittgenstein) rethinking the vocabulary of determination, prominent in Althusserian writings. This paper examines how semiotics, in conjunction with hermeneutics, can illuminate the structure of James Joyce's 'Ulysses' as a literary text. The paper begins with an account of two poet-critics who examined Joyce's novel in terms of classical myths and literary precedents. A crucial turning-point in the essay occurs when Jean Michel Rabate's Lacanian reading of the novel is introduced to clarify Joyce's use of the "signifier of absence" to clarify the meaning of paternity in the novel. The function (...) of the intertext is then examined, particularly in view of the relationship between Stephen Dedalus and Leopold Bloom. The conclusion of the paper shows how a dialogical reading supports the belief in a 'hermeneutical self' as part of the text's underlying meaning. (shrink)

Michèle Le Dœuff considers the relationship between Jean-Paul Sartre and Simone de Beauvoir as a paradigmatic case of what she calls an "erotico-theoretical transference" relationship: De Beauvoir devoted herself to Sartre theoretically by adopting his existentialist perspective for the analysis of reality in general and the analysis of women's oppression in particular. The latter is especially strange since Sartre used strongly sexist metaphors and adopted a macho attitude towards women. In her book Hipparchia's Choice, Le Dœuff speaks in this context (...) of "theoretical masculinism." She convincingly shows in this book that Sartre without using images could not have closed his existentialist philosophy: without the feminine drawback he would not have been able to explain why man cannot become god. Sartre not only understands gaining knowledge as a rape of a woman he also fears that the possessed feminine (body) could reverse its position from being dominated to the dominating force by appropriating the masculine through slime. In Being and Nothingness Sartre states that "slime is the revenge of the In-itself. A sickly–sweet, feminine revenge." Despite of the fact that De Beauvoir used Sartre's heterosexist ontology and metaphysics she managed to provide a highly influential depiction of women's condition and offered an original approach to the understanding of selfhood which places woman inside the subject. Michel Houellebecq’s Anéantir has received mixed reviews. Houellebecq’s focus on loving intimacy and care for the elderly within the nuclear family allegedly showcases his transformation from an embittered critic of the capitalist status quo to an apolitical novelist interested in the private sphere. I argue that this criticism overlooks Houellebecq’s concerns about old age and love in his earlier novels and how they relate to his social critique. Particularly Houellebecq’s Possibilité d’une île presents a critique of lonely precarity as (...) the dominant mode of being-in-the-world today. Though critics of post-Fordism have already described post-Fordist forms of life as opportunistic, fearful, and cynical, Houellebecq adds that this uncertain marketized lifestyle also leads to bitterness that increases with old age. By confronting Houellebecq’s phenomenology of contemporary life to Heidegger’s analysis of Dasein, I argue that, whereas Heidegger highlights the role of anxiety and death in fostering a sense of meaning to human existence, Houellebecq rather argues that such an authentic confrontation with death has become impossible in contemporary culture and that love is instead the emotional tonality most responsive to the cultivation of a meaningful good life. This paper tackles the problem of defining what a cognitive expert is. Starting from a shared intuition that the definition of an expert depends upon the conceptual function of expertise, I shed light on two main approaches to the notion of an expert: according to novice-oriented accounts of expertise, experts need to provide laypeople with information they lack in some domain; whereas, according to research-oriented accounts, experts need to contribute to the epistemic progress of their discipline. In this paper, I (...) defend the thesis that cognitive experts should be identified by their ability to perform the latter function rather than the former, as novice-oriented accounts, unlike research-oriented ones, fail to comply with the rules of a functionalist approach to expertise. This paper focuses on extant approaches to counteract the consumption of fake news online. Proponents of structural approaches suggest that our proneness to consuming fake news could only be reduced by reshaping the architecture of online environments. Proponents of educational approaches suggest that fake news consumers should be empowered to improve their epistemic agency. In this paper, we address a question that is relevant to this debate: namely, whether fake news consumers commit mistakes for which they can be criticized and (...) that they could easily avoid by reforming their doxastic conduct. Proponents of structural approaches, like R. Rini and B. Millar, have defended in different ways a negative answer to this question. In this paper, we criticize their views and suggest that individual users could improve on their epistemic practice by widening their information diet. (shrink)

This article introduces an account of moral education grounded in Zagzebski’s recent Exemplarist Moral Theory and discusses two problems that have to be solved for the account to become a realistic alternative to other educational models on the market, namely the limited-applicability problem and the problem of indoctrination. The first problem raises worries about the viability of the account in ordinary circumstances. The second charges the proposed educational model with indoctrinating students. According to a recent account of epistemic authority proposed by Linda Zagzebski (2012), it is rational for laypersons to believe on authority when they conscientiously judge that the authority is more likely to form true beliefs and avoid false ones than they are in some domain. Christoph Jäger (2016) has recently raised several objections to her view. By contrast, I argue that both theories fail to adequately capture what epistemic authority is, and I offer an alternative account grounded in the (...) abilities that different kinds of authorities are required to possess. While social geographers have convincingly made the case that space is not an external constant, but rather is produced through inter-relations, anthropologists and sociologists have done much to further an understanding of time, as itself constituted through social interaction and inter-relation. Their work suggests that time is not an apolitical background to social life, but shapes how we perceive and relate to others. For those interested in exploring issues such as identity, community and difference, this suggests that attending to how (...) temporal discourses are utilised in relation to these issues is a key task. This article seeks to contribute to an expansion of the debate about time and sociality by contributing an analysis of a variety of ways in which Gloria Anzaldúa utilises temporal concepts as part of her work of rethinking social identity and community. In particular, I suggest that in contesting homogeneous identity, Anzaldúa also implicitly contests linear temporal frameworks. Further, in creating new frameworks for identity, I suggest the possibility of discerning an alternative approach to time in her work that places difference at the heart of simultaneity. I suggest that the interconnection between concepts of time and community within Anzaldúa’s work indicates, more broadly, that attempts to rework understandings of relationality must be accompanied by reworked accounts of temporality. Nos textos escritos por Foucault durante os anos 60, a problemática antropológica amparava-se, dentre outros fatores, no argumento segundo o qual a modernidade se constitui a partir de uma “finitude constituinte” a substituir um “infinito originário”. A questão do infinito teria, portanto, duas funções: a descrição da epistémê clássica e a própria comparação desta com a epistémê moderna. Entretanto, em As Palavras e as Coisas o capítulo que abre as considerações sobre o período clássico não considera, em suas linhas maiores, (...) a questão do infinito. O argumento gira em torno da “representação”. Nesse contexto, o presente artigo tenta articular as questões do “infinito” e da “representação”, considerando os escritos foucaultianos e a literatura secundária. //////////////////////// -/- En considérant les textes de Foucault écrits pendant les années 60, le problème anthropologique impliquait, parmi d’autres facteurs, l’argument selon lequel la « modernité » serait constituée par une «finitude constituante» qui a remplacée « l’infini originaire » classique. Donc, la question de l’infini aurait au moins deux fonctions: la description de sa propre fonction classique et la comparaison de cette epistémê avec l’epistémê moderne. Par contre, dans l’argumentation de “Les Mots et les Choses”, le chapitre qui ouvre les considérations relatives à la période classique ne tient pas compte, dans ses grosses lignes, de la question de l’infini. L’argument tourne autour de la question de la «représentation». Dans ce contexte, cet article essaie d’articuler les questions de l’infini» et de la «représentation», en considérant les écrits de Foucault et la littérature secondaire. //////////////////////// -/- In the philosophical texts written by Michel Foucault in the decade of 1960, the so called anthropological problem was based, among other subjects, on the argument that the modernity is composed by a “constitutive finitude” that replaced the “originary infinity” of the classical age. Therefore, the question about “infinite” has in this period two functions: the description of the classical episteme itself and its comparison with the modern episteme. However, when one consider The Order of Things (one of the more important texts on this subject), the chapter that opens the argumentation about the classical age does not focuses, in its major lines, the question about the infinite. The argument revolves around the concept of “representation”. In considering this context, this article attempts to articulate the issues of “infinity” and representation”, considering Foucault’s writings and secondary literature. (shrink)

Epistemic paternalism is the thesis that in some circumstances we are justified in interfering with the inquiry of another for their own epistemic good without consulting them on the issue. In this paper, I address the issue of who is rationally entitled to undertake paternalistic interferences, and in virtue of which features one has this entitlement. First, I undermine the view according to which experts are the most apt people to act as paternalist interferers. Then, I argue that epistemic authorities (...) are in a better position to satisfy the requirements of justified epistemic paternalism, when conceived according to the service model of epistemic authority. Finally, I offer a virtue-based account of paternalist interferers and show how it can apply to cases in which the interferer is a group or an institution. (shrink)

Focusing particularly on the role of the clock in social life, this article explores the conventions we use to “tell the time.” I argue that although clock time generally appears to be an all-encompassing tool for social coordination, it is actually failing to coordinate us with some of the most pressing ecological changes currently taking place. Utilizing philosophical approaches to performativity to explore what might be going wrong, I then draw on Derrida’s and Haraway’s understandings of social change in order (...) to suggest a fairly unconventional, but perhaps more accurate, mode of reckoning time in the context of climate change, resource depletion, and mass extinctions. While possessing moral understanding is agreed to be a core epistemic and moral value, it remains a matter of dispute whether it can be acquired via testimony and whether it involves an ability to engage in moral reasoning. This paper addresses both issues with the aim of contributing to the current debates on moral understanding in moral epistemology and virtue ethics. It is argued that moral epistemologists should stop appealing to the argument from the transmissibility of moral understanding to make (...) a case for their favorite view of moral understanding. It is also argued that proponents of exemplarist moral theories cannot remain neutral on whether the ability to engage in moral reasoning is a necessary component of moral understanding. (shrink)

The surface grammar of reports such as ‘I have a pain in my leg’ suggests that pains are objects which are spatially located in parts of the body. We show that the parallel construction is not available in Mandarin. Further, four philosophically important grammatical features of such reports cannot be reproduced. This suggests that arguments and puzzles surrounding such reports may be tracking artefacts of English, rather than philosophically significant features of the world.

This paper explores what happens when artists fail to execute their goals. I argue that taxonomies of failure in general, and of failed-art in particular, should focus on the attempts which generate the failed-entity, and that to do this they must be sensitive to an attempt’s orientation. This account of failed-attempts delivers three important new insights into artistic practice: there can be no accidental art, only deliberate and incidental art; art’s intention-dependence entails the possibility of performative failure, but not of (...) failed-art; and art’s intention-dependence is perfectly compatible with the role that luck plays in artistic creation. It is widely agreed that fiction is necessarily incomplete, but some recent work postulates the existence of universal fictions—stories according to which everything is true. Building such a story is supposedly straightforward: authors can either assert that everything is true in their story, define a complement function that does the assertoric work for them, or, most compellingly, write a story combining a contradiction with the principle of explosion. The case for universal fictions thus turns on the intuitive priority we assign (...) to the law of non-contradiction. My goal in this paper is to show that our critical and reflective literary practices set constraints on story-telling which preclude universal fictions. I will raise four stumbling blocks for universal fictionalists: the gap between saying and making true, our actual interpretive reactions to story-level contradictions, the criteria we accept for what counts as a story in our literary practices, and the undesirability of the universal fictionalist’s closure principles. The premise that every work belongs to an art-kind has recently inspired a kind-centred approach to theories of art. Kind-centred analyses posit that we should abandon the project of giving a general theory of art and focus instead on giving theories of the arts. The main difficulty, however, is to explain what makes a given kind an art-kind in the first place. Kind-centred theorists have passed this buck on to appreciative practices, but this move proves unsatisfactory. I argue that the (...) root of this dissatisfaction stems not from the act of kicking the can down the road, but from not kicking it far enough. The missing ingredient, I argue, is a notion of convention which does the work of marking the difference between art and non-art for a given physical medium. (shrink)

This paper confronts Zagzebski’s exemplarism with the intertwined debates over the conditions of exemplarity and the unity-disunity of the virtues, to show the advantages of a pluralistic exemplar-based approach to moral education (PEBAME). PEBAME is based on a prima facie disunitarist perspective in moral theory, which amounts to admitting both exemplarity in all respects and single-virtue exemplarity. First, we account for the advantages of PEBAME, and we show how two figures in recent Italian history (Giorgio Perlasca and Gino Bartali) satisfy (...) Blum’s definitions of ‘moral hero’ and ‘moral saint’ (1988). Then, we offer a comparative analysis of the effectiveness of heroes and saints with respect to character education, according to four criteria derived from PEBAME: admirability, virtuousness, transparency, and imitability. Finally, we conclude that both unitarist and disunitarist exemplars are fundamental to character education; this is because of the hero's superiority to the saint with respect to imitability, a fundamental feature of the exemplar for character education. This paper takes issue with the exemplarist strategy of fostering virtue development with the specific goal of improving its applicability in the context of education. I argue that, for what matters educationally, we have good reasons to endorse a liberal account of moral exemplarity. Specifically, I challenge two key assumptions of Linda Zagzebski’s Exemplarist Moral Theory (2017), namely that moral exemplars are exceptionally virtuous agents and that imitating their behavior is the main strategy for acquiring the virtues. I will introduce (...) and discuss the notions of enkratic exemplars and injustice illuminators and show that we have good reasons to consider them moral exemplars although they fail to satisfy (either of) the key assumptions. Since the human genome was decoded, great emphasis has been placed on the unique, personal nature of the genome, along with the benefits that personalized medicine can bring to individuals and the importance of safeguarding genetic privacy. As a result, an equally important aspect of the human genome – its common nature – has been underappreciated and underrepresented in the ethics literature and policy dialogue surrounding genetics and genomics. This article will argue that, just as the personal nature of the (...) genome has been used to reinforce individual rights and justify important privacy protections, so too the common nature of the genome can be employed to support protections of the genome at a population level and policies designed to promote the public's wellbeing. In order for public health officials to have the authority to develop genetics policies for the sake of the public good, the genome must have not only a common, but also a public, dimension. This article contends that DNA carries a public dimension through the use of two conceptual frameworks: the common heritage framework and the common resource framework. Both frameworks establish a public interest in the human genome, but the CH framework can be used to justify policies aimed at preserving and protecting the genome, while the CR framework can be employed to justify policies for utilizing the genome for the public benefit. A variety of possible policy implications are discussed, with special attention paid to the use of large-scale genomics databases for public health research. (shrink)

This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. It is widely believed, among philosophers of literature, that imagining contradictions is as easy as telling or reading a story with contradictory content. Italo Calvino’s The Nonexistent Knight, for instance, concerns a knight who performs many brave deeds, but who does not exist. Anything at all, they argue, can be true in a story, including contradictions and other impossibilia. While most will readily concede that we cannot objectually imagine contradictions, they nevertheless insist that we can propositionally imagine them, and regularly (...) do, simply by entertaining a text which prompts us to do so. I argue that this narrative does not bear scrutiny for two main reasons. First, because propositional imagining is beside the point, where truth in fiction is concerned; evaluating truth in fiction engages the cognitive architecture in ways that prohibit the mobilization of merely propositional imagination to that end. And second, because it is not obvious, given the strategies usually suggested, that we ever propositionally imagine contradictions in the first place—in fact, it seems we go out of our way to avoid directly imagining them. Philosophers disagree about what the folk concept of pain is. This paper criticises existing theories of the folk concept of pain, i.e. the mental view, the bodily view, and the recently proposed polyeidic view. It puts forward an alternative proposal – the polysemy view – according to which pain terms like “sore,” “ache” and “hurt” are polysemous, where one sense refers to a mental state and another a bodily state, and the type of polysemy at issue reflects two distinct but (...) related concepts of pain. This chapter introduces a novel account of fake news and explains how it differs from other definitions on the market. The account locates the fakeness of an alleged news report in two main aspects related to its production, namely that its creators do not think to have sufficient evidence in favor of what they divulge and they fail to display the appropriate attitude towards the truth of the information they share. A key feature of our analysis is that it does (...) not require that fake news must be circulated with the intention to deceive one’s audience. In this way, our account overcomes a potential limitation of the current philosophical discussion about fake news, which appears to individuate the main problem with this phenomenon in the fact that fake news consumers are misled and misinformed. In contrast, the proposed analysis shows that an additional (and perhaps equally fundamental) problem uncovered by the spread of fake news is a widespread pathological relationship with information, one on which we consume information not to satisfy our interest in the truth but to strengthen our social identities and quench our hunger for social recognition. The paradox of pain refers to the idea that the folk concept of pain is paradoxical, treating pains as simultaneously mental states and bodily states. By taking a close look at our pain terms, this paper argues that there is no paradox of pain. The air of paradox dissolves once we recognize that pain terms are polysemous and that there are two separate but related concepts of pain rather than one.

There is a tendency to take mounted dinosaur skeletons at face value, as the raw data on which the science of paleontology is founded. But the truth is that mounted dinosaur skeletons are substantially intention-dependent—they are artifacts. More importantly, I argue, they are also substantially imagination-dependent: their production is substantially causally reliant on preparators’ creative imaginations, and their proper reception is predicated on audiences’ recreative imaginations. My main goal here is to show that dinosaur skeletal mounts are plausible candidates for (...) art-status. But, what is more, I think they are artworks—specifically, sculptures. (shrink)

Empirical evidence suggests that perceptual‐motor simulations are often constitutively involved in language comprehension. Call this “the simulation view of language comprehension”. This article applies the simulation view to illuminate the much‐discussed phenomenon of copredication, where a noun permits multiple predications which seem to select different senses of the noun simultaneously. On the proposed account, the (in)felicitousness of a copredicational sentence is closely associated with the perceptual simulations that the language user deploys in comprehending the sentence.

Recent research in psycholinguistics suggests that language processing frequently involves mental imagery. This paper focuses on visual imagery and discusses two issues regarding the processing of polysemous words (i.e. words with multiple related meanings or senses) – co-predication and sense-relatedness. It aims to show how mental imagery can illuminate these two issues.
